Terms & Conditions

 1 Booking

1.1 These booking conditions will apply to all confirmed bookings

1.2 Having identified Westacre Lodge as your choice, please either telephone us or send an e mail to confirm the dates you require. We will then contact you to confirm the booking and also to arrange payment (see below). Once payment is taken, we will email you to confirm the booking.

1.3 The booking should be made in one name only, and that person may not transfer the booking to another person without our prior written consent.

1.4 Bookings cannot be accepted from persons under 18 years of age.

1.5 Once a booking is confirmed it is not subject to change. If you choose to cancel see section 3 for details of the terms that will apply.

 

2 Payment and Security deposit

2.1 If a reservation is made more than 30 days prior to the holiday commencing:

2.1.1 a non-refundable deposit of 30% (“Rental Deposit”) of the total rental amount (“Rental Amount”) is payable at the time of booking; and

2.1.2 the balance of the total Rental Amount will become due 30 days before the holiday commences,

and in the event, we do not receive payment in full by the due date, we reserve the right to cancel the booking and in the event the Rental Deposit has been paid it will not be refunded to you.

2.2 If a reservation is made 30 days or less prior to the holiday commencing, the total Rental Amount is payable at the time of booking and the booking will not be accepted until the payment of the total Rental Amount is received.

2.3 We require a security deposit of £250.00 for Westacre Lodge (the “Security Deposit”). The security deposit is payable when the letting commences. The deposit will be refunded within 10 working days of the end of the letting period, subject to no retentions being made. In the event, we do not receive the security deposit in full, we reserve the right to immediately cancel the booking and in such circumstances the Rental Deposit will not be refunded.

2.4 The payment methods we accept are as follows:

Rental Amount:  Credit card or debit card / by cheque if it clears before the date of arrival / cash

Security Deposit: Credit card or debit card / cash

 

3 Cancellations

3.1 In the event of cancellation, you may be due a partial refund which is dependent on when notice of cancellation is given to us. The refund is calculated as follows:

30 days or less before the holiday start date:  No refund of the Rental Deposit or Rental Amount

More than 30 days before the holiday start date: Refund of an amount equal to Rental Amount less the Rental Deposit.

3.2 If a refund is due it will be paid within 10 working days of cancellation.

3.3 We advise you to take out appropriate insurance so that you are covered should you have to cancel involuntarily.

3.4 In the unlikely event that we cancel the booking, we will refund whatever monies we have received from you in full.

 

4 Description of Occupancy and Property

4.1 The property may be occupied for private holiday use only and no other form of tenancy is created.

4.2 We endeavour to describe Westacre Lodge as accurately as possible and to the best of our knowledge the details relating to Westacre Lodge are correct. However, we cannot accept any liability if you find that Westacre Lodge does not meet your expectations. We are happy to arrange a viewing of Westacre Lodge in advance of you making your booking.

 

5 Pets

5.1 Up to a maximum of two dogs are only allowed at Westacre Lodge provided neither is a puppy, large (meaning over 50 kilos in weight) and you inform us about the dogs at the time of making the booking.

5.2 The following dog terms apply:

5.2.1 dogs must be under strict control at all times while in or at Westacre Lodge;

5.2.2 any fouling must be cleared up without delay;

5.2.3 the dog owner must bring the dog’s bed or basket for sleeping in;

5.2.4 dogs must not be left alone in or at the Westacre Lodge at any time;

5.2.5 dogs must not lie on beds or furnishings, and hair must be cleared up before departing;

5.2.6 dog owners must ensure that their pets are free from parasites and fleas before they occupy the Westacre Lodge. Failure to do so may incur subsequent charges;

5.3 You will be liable for any damage caused by your dog. Any damage is to be reported to us immediately. Any additional cleaning required, that may incur an additional charge, will be at our sole discretion.

5.4 If you breach any term of this paragraph 5, we may notify you that you have broken these terms and may cancel your booking and ask that you leave Westacre Lodge before the end of the holiday period without compensation or that you pay an additional reasonable charge.

5.5 Save for dogs, no other pets are allowed at Westacre Lodge.

5.6 If you have an allergy to dogs, we cannot accept responsibility for any suffering which may occur as a result of animals having been present in Westacre Lodge.

 

6 Your Responsibilities

6.1 We will ensure that the property is thoroughly cleaned prior to your arrival, and we expect it to be left in a similar condition and state of repair when you depart. If the property is left in an unsuitable condition at the end of your let then we will instruct professional cleaners to clean the property and the cost of this will be deducted from your Security Deposit.

6.2 You will be fully liable for any damage done to the property or its contents during your let, and the cost of repairing the property or replacing contents will be deducted from of your Security Deposit. Should the cost of repairs or replacements exceed the amount of your Security Deposit, you will be liable to pay the excess.

6.3 Your right to occupy Westacre Lodge may be forfeited without compensation if:

6.3.1 more people or dogs than declared to us at the time of booking or before the commencement of the holiday, attempt to take up occupation;

6.3.2 overnight guests are entertained without our express permission;

6.3.3 any activity is undertaken which is illegal, or may cause damage, noise or disturbance; or

6.3.4 you smoke in Westacre Lodge.

6.4 You must ensure that whenever the property is unoccupied it is properly secured by ensuring that all doors and windows are closed and locked.

 

7 Governing Law

7.1 Any dispute, claim or other matter which may arise in relation to your booking will be governed by Scottish law and you agree that any dispute will be dealt with exclusively by the courts of Scotland.
